Welcome to The Next Step Athletic Recruitment ("TNS", "we", "us", or "our"). These Terms and Conditions ("Terms") govern your use of our website at tnsrecruit.com and all related services provided by The Next Step Athletic Recruitment.
By accessing or using our services, you ("Client", "you", or "your") agree to be bound by these Terms. If you do not agree to these Terms, you may not use our services.
The Next Step Athletic Recruitment is operated by TNS Sports Consulting Inc., a company incorporated under the laws of Canada.
The Next Step Athletic Recruitment provides the following services:
We reserve the right to modify, suspend, or discontinue any service at any time without prior notice.
4.1 Accurate Information: You agree to provide accurate, complete, and current information about yourself, your athletic achievements, and academic standing.
4.2 Compliance and External Factors: You are responsible for complying with all NCAA, NAIA, JUCO, and USPORTS eligibility rules and regulations. We provide guidance but are not responsible for your eligibility status. We are not responsible for any factors outside of our direct control, including but not limited to: changes in eligibility requirements, coach departures, program budget cuts, roster limitations, academic standards modifications, visa denials, injury status, athletic performance variations, or any other circumstances beyond our reasonable control that may affect your recruitment process.
4.3 Communication: You agree to respond promptly to our communications and provide requested materials in a timely manner.
4.4 Proper Use of Coach Contacts: Coach contact information must be used solely for legitimate recruitment purposes. Spam, harassment, or misuse of contact data is strictly prohibited. You agree to respect coaches' time and follow professional communication standards.
4.5 Coach Contact Removal Requests: We respect coaches' privacy and preferences. If any coach requests to have their contact information removed from our database, we will honor such requests promptly. Clients acknowledge that coach contact lists may be updated or modified to remove contacts who have opted out, and no refund or compensation will be provided for such removals.
3.1 Pricing: All prices are listed in USD unless otherwise specified. Coach contact lists start at $29. Consultation and video creation services are priced individually based on scope and requirements.
3.2 Payment: Payment is required in full before service delivery unless otherwise agreed upon in writing. We accept major credit cards and electronic payments through secure payment processors.
3.3 No Refunds Policy: ALL SALES ARE FINAL. We do not offer refunds for any services, including but not limited to coach contact lists, consultation services, video creation, or any other services provided. This policy exists due to the significant time, effort, and resources invested by our internal team in preparing and delivering personalized services. By making a purchase, you acknowledge and accept this no-refund policy.
3.4 Purchase as Agreement: By completing any purchase or payment for our services, you are digitally signing and agreeing to these Terms and Conditions. No separate physical contract is required. Your purchase constitutes your acceptance of all terms, conditions, and policies outlined in this document.
3.5 Late Payments: For consultation services with payment plans, late payments may result in immediate suspension of services without refund of previously paid amounts.

5.1 ABSOLUTELY NO GUARANTEE OF RESULTS: WE EXPLICITLY DO NOT GUARANTEE, WARRANT, OR PROMISE THAT OUR SERVICES WILL RESULT IN COLLEGE RECRUITMENT, SCHOLARSHIP OFFERS, ADMISSION TO ANY INSTITUTION, OR ANY SPECIFIC OUTCOME WHATSOEVER. Athletic recruitment is highly competitive and depends on numerous factors entirely beyond our control, including but not limited to: your athletic performance, academic qualifications, coach preferences, team needs, budget constraints, timing, competition from other athletes, and changing institutional priorities.
5.2 No Success Guarantees: Any testimonials, success stories, or examples of past client achievements do not guarantee future results. Each student-athlete's situation is unique, and past performance of our services does not predict future outcomes for any individual client.
5.3 Information Accuracy: While we strive to maintain current and accurate coach contact information, we cannot guarantee the accuracy, completeness, or timeliness of all data. Coaching staff changes frequently in collegiate athletics, and contact information may become outdated without notice.
5.4 Third-Party Services: We may recommend or work with third-party services. We are not responsible for the actions, services, policies, or outcomes of these third parties.
5.5 Educational Guidance Only: Our academic planning services are for guidance only. You remain solely responsible for meeting all academic and eligibility requirements. We are not academic counselors or official NCAA compliance officers.
5.6 Service Availability: We reserve the right to modify, suspend, or discontinue any service at any time without prior notice and without liability to you.
6.1 Our Content: All content on our website, including text, graphics, logos, and software, is owned by The Next Step Athletic Recruitment and protected by copyright and trademark laws.
6.2 Client Content: You retain ownership of materials you provide to us (videos, transcripts, etc.). By providing these materials, you grant us permission to use them for service delivery and promotional purposes.
6.3 Video Creation: Videos we create remain your property, but we retain the right to use them for promotional purposes unless otherwise agreed in writing.
7.1 Data Collection: We collect personal information necessary to provide our services, including contact information, academic records, and athletic achievements.
7.2 Data Use: Your information is used solely for service delivery, communication, and improving our services. We do not sell personal information to third parties.
7.3 Data Security: We implement reasonable security measures to protect your information, but cannot guarantee absolute security of electronic communications.
7.4 Data Retention: We retain client information for as long as necessary to provide services and comply with legal obligations.
8.1 Maximum Liability: Our total liability to you for any and all claims arising from our services, regardless of the cause of action, shall not exceed the amount you paid for our services in the 12 months preceding the claim.
8.2 No Consequential Damages: Under no circumstances shall we be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to lost opportunities, lost scholarships, lost profits, emotional distress, or any other damages arising from the use of our services, even if we have been advised of the possibility of such damages.
8.3 No Liability for Recruitment Outcomes: We shall not be liable for any failure to secure college recruitment, scholarship offers, or admission to any institution. We are not responsible for missed opportunities, rejected applications, or any negative outcomes in the recruitment process.
8.4 Force Majeure: We are not liable for delays or failures due to circumstances beyond our reasonable control, including natural disasters, government actions, technical failures, coach departures, program changes, or other unforeseeable events.
8.5 Time Limitation: Any claim against us must be brought within one (1) year of the date the claim arose, or it will be forever barred.
9.1 Termination by You: You may terminate our services at any time by providing written notice. Refunds, if applicable, will be provided according to our refund policy.
9.2 Termination by Us: We may terminate services immediately if you breach these Terms, provide false information, or engage in prohibited conduct.
9.3 Effect of Termination: Upon termination, your access to our services will cease, but these Terms will continue to apply to past use of our services.
10.1 Governing Law: These Terms are governed by the laws of Ontario, Canada, without regard to conflict of law principles.
10.2 Jurisdiction: Any disputes arising from these Terms or our services shall be resolved in the courts of Ontario, Canada.
10.3 Mediation: Before pursuing legal action, parties agree to attempt resolution through good faith negotiation and, if necessary, mediation.
11.1 Modifications: We may update these Terms at any time. Changes will be effective immediately upon posting on our website. Continued use of our services constitutes acceptance of modified Terms.
11.2 Severability: If any provision of these Terms is found unenforceable, the remaining provisions will remain in full force and effect.
11.3 Entire Agreement: These Terms constitute the entire agreement between you and The Next Step Athletic Recruitment regarding our services.
11.4 Assignment: You may not assign your rights under these Terms without our written consent. We may assign our rights and obligations without restriction.
